Data protection information for applicants

We are pleased that you are interested in us and that you have applied or are applying for a position in our company. In the following we would like to provide you with information on the processing of your personal data in connection with your application.

Who is responsible for data processing?

Which of your data are processed by us? And for what purposes?

We process the data you send us in connection with your application in order to check your suit­ability for the position (or other open positions in our companies, if applicable) and to carry out the application procedure.

On what legal basis is this based?

The legal basis for the processing of your personal data in this application procedure is primarily § 26 BDSG in the version valid from 25.05.2018. According to this, the processing of data required in connection with the decision to establish an employment rela­tionship is permissible.

Should the data be required for legal prosecution after the application procedure has been completed, data processing may be carried out on the basis of the requirements of Art. 6 DSGVO, in particular to safeguard legitimate interests in accordance with Art. 6 Para. 1 letter f) DSGVO. Our interest then consists in the assertion or defence of claims.

How long is the data stored?

Data of applicants will be deleted after 6 months in the event of rejection.

In the event that you have agreed to further storage of your personal data, we will transfer your data to our applicant pool. There the data will be deleted after two years.

If you have been awarded a job during the application procedure, the data will be trans­ferred from the applicant data system to our personnel information system.

To which recipients will the data be trans­ferred?

We partly use the specialized software provider HRworks for the application process. This company acts as a service provider for us and may also become aware of your personal data in connection with the main­tenance and servicing of the systems. We have concluded a so-called order processing contract with this provider, which ensures that the data processing is carried out in a permissible manner.

Your applicant data will be screened by the personnel department after receipt of your application. Suitable applic­ations will then be forwarded internally to the department responsible for the respective vacant position. The further procedure is then coordinated. Within the company, only those persons who need access to your data for the proper processing of our application procedure have access to it.

Where is the data processed?

The data is processed on IT systems in our server room. Apart from admin­is­trators, only members of the personnel department and the company management have access to these IT systems. Files are kept in secure archives.

The applicant platform HRworks uses the services of Amazon Web Services. This enables HRworks to store customer data on servers in data centers with the highest possible security standards. Thus, also regarding the server location the guarantee of maximum protection can be guar­anteed.

The server location used by HRworks is located within the European Union, in the AWS High Security Centre in Ireland. Further, detailed information on data protection by AWS can be found at: aws.amazon.com/en/security/platform. HRworks uses the latest encryption tech­nology (SSL encryption) for the trans­mission of data.

Your rights as “data subject”

You have the right to be informed about the personal data we process about you.

In the case of a request for information that is not made in writing, we ask for your under­standing that we may then require you to provide evidence that proves that you are the person you claim to be.

Furthermore, you have the right to correct or delete your personal data or to restrict its processing to the extent that you are legally entitled to do so.

Furthermore, you have the right to object to the processing within the scope of the legal requirements. The same applies to a right to data trans­fer­ability.
